Terms and Conditions for Donors and Other Users .

In this document:
-"Masjid Al Khair" refers to ;Masjid Al Khair and includes its officers, directors, agents, volunteers and employees.
-"http://alkhair-mosque.org.sg and courseregistration.http://alkhair-mosque.org.sg" ;refers to the portal that provides the information and/or functions associated with it, whether in whole or in part.
-"User" ;refers to the donor and/or any third party using http://alkhair-mosque.org.sg

1.There is a minimum donation amount of SGD5 and a maximum of SGD3000. All donations shall be in whole dollars (no cents).

2.Donation transactions must be made using the means specified by ;http://alkhair-mosque.org.sg including, without limitation, type of debit card or bank.

3.Donations made to Masjid Al Khair's various donation scheme will be for that donation type only and there shall be no substitution of donations type.

4.All donations are non-refundable.

5.Masjid Al Khair does not warrant that donations will be used for any particular purpose. After donations are made, all further dealings are solely between the donor and Masjid Al Khair.

6. For all purchases made through the website, the consumer shall designate upon order confirmation the address for delivery of the products. The Consumer shall bear and pay to Masjid Al Khair:
a) The delivery and shipment charges
b) The delivery, re-delivery, forwarding, shipment, re-shipment and administrative costs, tax duties, storage and disposal charges for any item(s) which is/are rejected by the consumer where such rejection is not made pursuant to an express right of the Consumer under these conditions, or where any delivery to the Consumer is unsuccessful for any reason.

7.Masjid Al Khair shall deliver the package(s) to the delivery address as designated by the Consumer and agreed to by mosque. In the event that nobody is present to receive the package, additional charges will apply for re-delivery. Please provide your contact number under the address selected upon checkout so that the courier can reach you under any unforeseen circumstances.

8.Any shipment or delivery dates provided by Masjid Al Khair are estimates only and shall not form part of the contract. Masjid Al Khair is not liable for any loss, damage or costs incurred should any unforeseen
circumstances cause a delay/failure to meet any given shipment or delivery dates.

9.Personal Data, as defined by the Personal Data Protection Act 2012 (No. 26 of 2013), provided on Masjid Al Khair by User shall be subject to PDPC Privacy Policy.

10.Masjid Al Khair reserves the right at its sole discretion to deny or restrict access to ;http://alkhair-mosque.org.sg to any party at any time.

11.Masjid Al Khair reserves the right at its sole discretion to modify, suspend or discontinue, temporarily or permanently, ;http://alkhair-mosque.org.sg at any time. Such right may be exercised without prior notice for reasons that may or may not be beyond Masjid Al Khair's control, including but not limited to internet, email, network, computer hardware and/or software malfunction, failure, damage or delay.

12.User agrees not to decompile, reverse engineer, modify, compile, and/or commercially exploit ;http://alkhair-mosque.org.sg and/or in any way whatsoever allow any third party access
to ;http://alkhair-mosque.org.sg for any unlawful or unauthorised purpose.

13.http://alkhair-mosque.org.sgis provided on an ";as is" and "as available" basis without warranties of any kind, either express or implied, statutory or otherwise. Use of ;http://alkhair-mosque.org.sg is solely at the user's own risk.

14.To the fullest extent permitted by law, Masjid Al Khair does not warrant and disclaims any and all other warranties, whether express or implied, including but not limited to:
a) The accuracy, correctness, reliability, timeliness, non-infringement, title, merchantability or fitness for any particular purpose of http://alkhair-mosque.org.sg or part thereof, including
hyperlinks to;or ;services from other parties; and/or
b) That ;http://alkhair-mosque.org.sg will be uninterrupted or error-free, or that defects will be corrected or that it is and will be free of all viruses and/or other harmful elements.

15.Masjid Al Khair shall not be liable in any event to any user for failure of any service or any damage (including but not limited to special, consequential, or exemplary damages) or loss of any kind in connection with the use of ;http://alkhair-mosque.org.sg, including but not limited to any damage or loss suffered (including any failure to receive any donations via ;http://alkhair-mosque.org.sg) in connection with access to, use of, denial of access or restricted access to, modification, suspension and/or discontinuation of ;http://alkhair-mosque.org.sg

16.Without prejudice to the generality of the foregoing, Masjid Al Khair shall not be liable for any defect, default, deficiency or malfunction in any device, computer, internet service provider or
telecommunication system or network, viruses or other malicious software or denial of service attacks that may affect the use of ;http://alkhair-mosque.org.sg

17.User agrees that use of ;http://alkhair-mosque.org.sg is conditioned upon user's waiver of any right to sue Masjid Al Khair for damages or losses related to the use of ;http://alkhair-mosque.org.sg

18.No failure to exercise, nor any delay in exercising, on the part of Masjid Al Khair, any right under these terms and conditions shall operate as a waiver thereof.

19.The headings in this Agreement are for ease of reference only and shall not be taken into consideration in the construction or interpretation of this Agreement.

20.If any provision of this Agreement is deemed unlawful or unenforceable, such provision shall be severed from this Agreement without prejudice to all other provisions which shall remain
enforceable.

21.The construction and interpretation of this Agreement shall be subject to and governed by the laws of Singapore. The user agrees to submit to the exclusive jurisdiction of the courts in Singapore.

22.A person who is not a party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act to enforce any of its terms and conditions.

23.Masjid Al Khair reserves the right, at its sole discretion, to vary the above terms and conditions from time to time. This Agreement may not be varied except in writing signed by a duly authorised officer or representative of Masjid Al Khair.

24.Use and/or continued use of ;http://alkhair-mosque.org.sg constitute agreement by the user to be bound by the terms and conditions, which may change from time to time. If you do not agree to these terms and conditions, please do not use ;http://alkhair-mosque.org.sg
